Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Tio Boh mobile application and the website tioboh.com (collectively, the “Service”). The Service is operated by Tio Boh, a sole proprietorship based in Singapore (“we”, “us”, “our”). The website serves as a marketing and informational resource; the core product is the Tio Boh mobile application.

By downloading, installing, or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 years of age, you must have the consent of a parent or legal guardian to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. The Service

Tio Boh is a Hokkien language learning app that provides lessons, exercises, and progress tracking to help users learn Singaporean Hokkien. The Service is provided free of charge. We reserve the right to introduce paid features or subscriptions in the future; any such offerings will be governed by additional terms presented to you at the time of purchase. You may optionally create an account to save your learning progress and sync it across devices.

4. Use of the Service

You may use the Service for personal, non-commercial purposes only. When using the Service, you agree not to:

• Misuse, disrupt, or interfere with the operation of the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated tools, bots, or scrapers to access or extract content from the Service
• Attempt to gain unauthorised access to any part of the Service or its systems
• Use the Service for any unlawful purpose or in violation of any applicable law
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity

5. Accounts

Creating an account is optional. If you choose to create one, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account. Accounts are personal and may not be shared with or transferred to any other person. You may delete your account at any time by contacting us at contact@tioboh.sg.

6. Intellectual Property

All content, design, branding, course material, and software associated with the Service are the property of Tio Boh or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written permission.

7. User Content

You retain ownership of any content you create through the Service. By submitting or creating content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and process your content solely for the purpose of delivering and improving the Service. This licence terminates when you delete your account or remove the relevant content, except where your content has been shared with other users or incorporated into aggregate, anonymised data. We reserve the right to remove any user content that violates these Terms.

8. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control, including but not limited to internet outages, natural disasters, or third-party service failures. We shall not be liable for any loss or inconvenience caused by such unavailability.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of the Service or its content. Tio Boh is an educational tool designed to support Hokkien language learning; it is not a certified language course or accredited educational institution.

10. Limitation of Liability

To the maximum extent permitted by the laws of Singapore, Tio Boh shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount paid by you to us (if any) in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tio Boh and its owner, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or restrict your access to the Service if we reasonably believe you have violated these Terms. Where practicable, we will provide notice and an opportunity to remedy the violation before terminating your access, except in cases of serious or repeated violations where immediate action is necessary.

You may stop using the Service at any time. If you have an account, you may request its deletion by contacting us. Upon termination, your right to use the Service ceases immediately. The provisions of these Terms that by their nature should survive will remain in effect, including intellectual property, disclaimers, limitation of liability, and indemnification.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on our website, updating the effective date, and where reasonably practicable, notifying you via email or an in-app notice. Your continued use of the Service after such notification constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.

14. Dispute Resolution

If a dispute arises in connection with these Terms or the Service, we encourage you to first contact us at contact@tioboh.sg so that we may attempt to resolve the matter informally. If the dispute cannot be resolved within thirty (30) days, either party may pursue formal resolution.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Singapore. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Singapore.

16. General Provisions

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, provided the assignee agrees to be bound by these Terms.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tio Boh regarding the use of the Service and supersede any prior agreements or understandings.
